Cannabis has been legal for adult use in New Jersey for several years now, but the rules around buying, carrying, using, and traveling with it can still feel confusing. Is Cannabis Legal in New Jersey?
Yes. Recreational cannabis is legal in New Jersey for adults 21 and older. Voters approved a constitutional amendment to legalize adult-use cannabis in November 2020, and Governor Phil Murphy signed the implementing legislation, known as the Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act (the CREAMM Act) — in February 2021. Licensed adult-use sales began on April 21, 2022.
Medical cannabis has been legal in New Jersey since 2010 under the Compassionate Use Medical Marijuana Act, which was later expanded by the Jake Honig Compassionate Use Medical Cannabis Act in 2019. Both programs are now overseen by the New Jersey Cannabis Regulatory Commission, the state agency responsible for licensing dispensaries, setting product safety standards, and enforcing the rules.
A few things have not changed:
- Cannabis is still a Schedule I controlled substance under federal law
- You can only buy cannabis from a licensed New Jersey dispensary
- Public consumption rules and driving laws are strictly enforced

Who Can Buy Cannabis in New Jersey?
Recreational (Adult-Use) Customers
Anyone 21 or older with a valid government-issued photo ID can buy cannabis from a licensed New Jersey dispensary. That includes residents and out-of-state visitors. Acceptable IDs include a driver’s license, state ID card, U.S. passport, or military ID. Every customer gets ID-checked at the door before entering the retail floor — no exceptions.
You do not need to register with the state, get a card, or sign up for anything to buy recreational cannabis. Walk in, show ID, browse the menu, ask questions, check out.
Medical Cannabis Patients
New Jersey’s Medicinal Cannabis Program serves patients with qualifying conditions like chronic pain, anxiety, PTSD, cancer, multiple sclerosis, glaucoma, and others. To enroll, patients consult with a registered healthcare provider, receive an authorization, and register with the state to receive a medical cannabis ID card.
Registered patients get a few meaningful benefits over recreational customers:
- No state sales tax on medical purchases
- Higher purchase allowances based on physician recommendations
- Designated caregivers can purchase on a patient’s behalf
Some New Jersey dispensaries serve only medical patients, while others (including most adult-use retailers) serve both populations. If you’re a registered patient, just let the team know when you arrive.
How Much Cannabis Can You Buy and Possess?
Two different limits apply, and people mix them up all the time. One controls how much you can buy in a single trip; the other controls how much you can have on you or at home.
Per-Transaction Purchase Limits
A licensed New Jersey dispensary can sell up to the equivalent of 1 ounce (28.35 grams) of usable cannabis per transaction. That limit can be filled with one product type or a combination, including:
- Up to 1 ounce of dried flower
- Up to 4 grams of solid concentrate (or the equivalent in liquid form, measured in milliliters)
- Up to 1,000 mg of ingested THC in edibles
- Pre-rolls, vapes, drinks, and tinctures, with each form counted toward the equivalent of 1 ounce
Mixed orders are common. A typical combined transaction might be a half-ounce of flower plus a few grams of concentrate, or a couple packs of edibles plus some pre-rolls — as long as the total doesn’t exceed the 1-ounce equivalent.
Possession Limits
Adults 21 and older can legally possess up to 6 ounces of cannabis at any time. This is the broader limit that applies wherever you go in New Jersey — at home, in transit (subject to vehicle rules below), or wherever consumption is otherwise permitted.
Going over 6 ounces moves cannabis possession from a legal activity into a fourth-degree crime under New Jersey law, with potentially serious penalties. Stay well under the limit and there’s nothing to worry about.
You’re also allowed to gift up to 1 ounce to another adult 21 or older, but only with no compensation involved. “Gifting” arrangements where a cash payment for something else triggers a “free” cannabis gift are illegal.
Where You Can (and Can't) Use Cannabis in New Jersey
This is the area that catches the most people off guard. Buying cannabis is straightforward; consuming it has more rules than people expect.
Generally allowed:
- On private property, as long as the property owner permits it
- In your own home, unless your lease or condo association prohibits it
Generally not allowed:
- Sidewalks, parks, beaches, boardwalks, and other public spaces
- Inside vehicles, whether moving or parked
- Schools, school grounds, and within set distances of youth-serving facilities
- Most workplaces
- Anywhere tobacco smoking is already banned (the same rules apply to cannabis smoking)
- Federal property, including national parks and post offices
Landlords retain the right to prohibit smoking cannabis in rental units, although they generally cannot prohibit possession or non-smoked use. Hotels usually prohibit cannabis use entirely.
Consumption lounges are a developing category in New Jersey. The CRC is rolling out a licensing framework for on-site consumption spaces that would allow adults 21+ to legally use cannabis at the venue itself. Availability is still limited statewide.
The simplest rule: if you wouldn’t smoke a cigarette there, don’t consume cannabis there.
Cannabis and Driving in New Jersey
Driving under the influence of cannabis is illegal in New Jersey under N.J.S.A. 39:4-50. The state uses an impairment standard rather than a blood-THC threshold, which means law enforcement officers — including specially certified Drug Recognition Experts — make impairment determinations through observation and field testing.
If you’re transporting cannabis in a vehicle, follow these rules:
- Keep products in the original sealed packaging
- Store cannabis somewhere not accessible to the driver, like the trunk
- Never consume in a vehicle, even as a passenger
- Don’t drive after using, regardless of how you feel
Medical cannabis patients are not exempt from DUI laws. A valid medical card does not give anyone the right to drive impaired.
Can You Grow Your Own Cannabis at Home?
No. New Jersey is one of the few legal-cannabis states that does not allow home cultivation. This applies to both recreational consumers and medical patients. Growing cannabis without a state-issued cultivation license is a criminal offense, regardless of the number of plants.
Bills to legalize personal home cultivation have been introduced in the legislature multiple times and remain under discussion, but as of now, the only legal way to obtain cannabis in New Jersey is through a licensed dispensary.
How Cannabis Is Taxed in New Jersey
New Jersey’s cannabis tax structure is actually one of the simpler ones among legal states. Adult-use purchases are subject to:
- 6.625% state sales tax (the same rate as most other taxable goods in NJ)
- Up to 2% local cannabis transfer tax (varies by municipality)
- A small Social Equity Excise Fee at the cultivator level, which is built into the wholesale price rather than charged separately to consumers
For the calendar year beginning January 1, 2026, the CRC voted to keep the Social Equity Excise Fee at $2.50 per ounce. This fee is paid by cultivators, not customers, but it does indirectly affect retail pricing.
Total cannabis tax for consumers typically lands between 6.625% and 8.625% depending on the municipality. Medical cannabis is exempt from state sales tax — another reason patients often save meaningfully on long-term purchases.
Where does the tax money go? Cannabis revenue funds the CRC itself, supports community reinvestment programs in areas most impacted by past drug enforcement, and contributes to local services in towns that host dispensaries.
Cannabis Delivery Laws in New Jersey

Housing. Public housing authorities and federally subsidized housing typically prohibit cannabis use because of federal law. Private landlords have discretion over their own properties.
Expungement. The CREAMM Act mandated automatic expungement of many older cannabis-related convictions, particularly for low-level possession and distribution offenses.
